TERMS OF USE & SERVICE AGREEMENT

1. ACCEPTANCE OF TERMS

Welcome to ProEdge-Sports.

These Terms of Use ("Terms") constitute a legally binding agreement between you ("The User," "Member," or "You") and ProEdge-Sports ("The Company," "We," "Us," or "Our").

By accessing our website (www.proedge-sports.com), purchasing our digital products (e.g., "Cricket Cards"), or joining our training platform (The ProEdge Academy), you agree to be bound by these Terms.

IF YOU DO NOT AGREE WITH THESE TERMS, YOU MUST NOT USE OUR SERVICES.

2. MEMBERSHIP & ACCOUNT SECURITY

2.1 Eligibility & Minors

The ProEdge Academy is designed for athletes of various ages, but strict rules apply:

• Under 13s: You are strictly prohibited from creating an account yourself. A parent or legal guardian must create and manage the account.

• Ages 13–17: You may use the services only with the permission of a parent or legal guardian. By using the service, you represent that you have received such permission.

• Parental Responsibility: If you are a parent allowing a minor to use the account, you accept full responsibility for their conduct, video uploads, and safety while using the platform.

2.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials. You agree to:

• Not share your password with anyone else (account sharing is grounds for immediate termination).

• Notify us immediately of any unauthorized use of your account.

• Ensure that your account information (email, payment details) is kept up to date.

3. SERVICES & PAYMENTS

3.1 Digital Content ("Cricket Cards" & Courses)

We grant you a limited, non-exclusive, non-transferable license to access and view the digital training content for your personal, non-commercial use. You may not download (unless expressly permitted), redistribute, sell, or share this content.

3.2 Subscriptions & Billing

• Payments: All payments are processed securely via third-party processors (e.g., Stripe).

• Renewal: Subscription memberships (if applicable) will automatically renew at the end of the billing cycle unless cancelled at least 24 hours prior to the renewal date.

• Cancellations: You may cancel your subscription at any time via your account settings. Access will continue until the end of the current billing period.

• Refunds: As our services include immediate access to digital content, we do not generally offer refunds once the content has been accessed, except where required by UK Consumer Law (Consumer Rights Act 2015).

4. USER CONDUCT (THE "LOCKER ROOM" RULES)

The ProEdge Academy is a professional training environment. To maintain a safe community, you agree NOT to:

1. Harass or Bully: Use the platform to threaten, harass, abuse, or intimidate other athletes or coaches.

2. Post Inappropriate Content: Upload videos or comments that are sexually explicit, violent, discriminatory, or offensive.

3. Spam: Post unauthorized advertising, promotional materials, or "spam" in community forums.

4. Infringe Privacy: Upload videos containing private information of others (e.g., car license plates, house numbers) or featuring individuals who have not consented to be filmed.

Violation of these rules may result in immediate account suspension or permanent banning without refund.

5. USER-GENERATED CONTENT (VIDEO UPLOADS)

When you upload video footage (e.g., batting technique videos) or post comments to The ProEdge Academy:

1. Ownership: You retain ownership of your content.

2. License to Us: You grant ProEdge-Sports a worldwide, royalty-free, perpetual license to host, display, reproduce, and analyze your content within the platform for the purpose of providing coaching services and operating the community.

3. Coaching Feedback: You understand that by uploading a video for analysis, you are inviting critique and feedback from ProEdge coaches.

6. HEALTH & SAFETY DISCLAIMER (READ CAREFULLY)

THE SERVICES PROVIDED BY PROEDGE-SPORTS ARE FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY.

1. Not Medical Advice: Our coaching, drills, and "Cricket Cards" do not constitute medical advice or physiotherapy.

2. Assumption of Risk: Physical training involves an inherent risk of injury. By participating in our programs, you voluntarily assume all risks associated with such activities, including but not limited to muscle strains, sprains, falls, or other injuries.

3. Consult a Physician: You should consult with a doctor or medical professional before beginning any new fitness or training regime, especially if you have a pre-existing medical condition.

4. Limitation of Liability: To the fullest extent permitted by law, ProEdge-Sports shall not be liable for any injury, loss, or damage arising out of your practice of the drills or techniques presented on our platform.

7. INTELLECTUAL PROPERTY RIGHTS

The ProEdge-Sports brand, the "Cricket Card" concept, the website design, logos, video content (produced by us), and course materials are the exclusive intellectual property of ProEdge-Sports.

You are prohibited from:

• Copying, reproducing, or modifying our content.

• Using our trademarks or logos without prior written consent.

• Reverse-engineering the platform technology.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law:

• ProEdge-Sports shall not be liable for any indirect, incidental, special, or consequential damages (including loss of data or profit) arising from your use of the service.

• Our total liability to you for any claim arising out of these Terms or the Service shall be limited to the amount you paid us in the 12 months preceding the event giving rise to the claim.

Note: Nothing in these Terms excludes our liability for death or personal injury caused by our negligence, or for fraud.

9. THIRD-PARTY LINKS

Our service may contain links to third-party websites or services (e.g., equipment retailers) that are not owned or controlled by ProEdge-Sports. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites.

10. TERMINATION

We may terminate or suspend your account and deny access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

11. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under this agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
